Salt Lake City Foreclosure Defense Lawyers

If you are facing foreclosure in Utah, there may be a way to avoid it or at least postpone it. At Bostwick & Price P.C. in Salt Lake City, Utah, our lawyers will help you explore your legal options to see if there is a way to keep you in your home.

Banks are typically unwilling to negotiate with homeowners who are behind on their mortgage payments and may even refuse to accept payments once they consider you in default. With a lawyer's help, you may be able to put yourself in a position where the bank will listen to you and negotiate new terms on the loan, extend payments or reduce interest.

Is There a Way to Stop Home Foreclosure in Utah?

There are generally two grounds on which a lawyer can challenge foreclosure of your home:

  • Procedural defense: If the bank did not do all of the things it was supposed to do in processing your home foreclosure, our lawyers can file suit to stop the foreclosure on procedural grounds.
  • MERS challenge: One of the reasons we are going through an economic upheaval is because of MERS — Mortgage Electronic Registration Systems — which allowed banks to bundle mortgages as securities and sell on the secondary market. While MERS lawsuits have been less successful in Utah than in other states, it may be worth exploring.

If you were talked into refinancing your home on terms that were unfavorable to you, we may be able to argue that the mortgage broker did you a disservice and you may have rights that you can pursue.
